Vienna Civil Lawyer

Civil law is one of the two main legal and judicial systems used around the world. The source of Civil Law primarily comes from statutes and legislation passed from a government. Civil law systems give the most precedent to what the law says, verses how cases have been ruled on in the past.

In a civil law system, Judges serve as the chief investigator. Judges decide the factors of a case, establish evidence, and then issue a ruling based on the application of law. Past decisions on similar matters are minimized. In civil law countries, attorneys gather and present evidence, and are questioned by the judge. Questions to parties and witnesses are often asked by judges as well, rather than the attorneys themselves.

Within Civil Law, there are several subcategories of legal theory, based on where the law was developed.

  • French or Napoleonic
  • Germany
  • Scandinavian
  • Chinese

Most of Europe, and most of Asia employ legal systems based on Civil Law. The United States, the United Kingdom, Canada, Australia, and India use the Common Law system. Nearly every other country uses some combination of the two.
