Roger S. Kobert is a Partner in Barton’s Litigation Group in New York.
As a trial attorney with more than 35 years’ experience, Roger represents foreign and domestic businesses, individuals, and governments in litigation, arbitration, and appeals, leading cross-border, multinational, and domestic dispute resolution teams focused on resolving disputes.
Roger handles a wide range of matters, including commercial, financial, and real estate disputes; banking; directors and officers liability; foreign sovereign immunity; insurance coverage; investment and fraud claims; class actions; section 1782 proceedings; labor and employment; corporate, financial, securities, shareholder, LLC and partnership counseling and disputes; managed health care litigation; aviation; franchise; fee recovery and enforcement; transactional representation; and creditor’s rights.
Roger has tried a large number of cases, argued appeals in federal and state courts across the United States, and arbitrated and mediated many more. He acted as lead counsel in litigation against a former head of state for crimes against humanity; established a new standard for franchisor tort immunity in the Florida Supreme Court; secured the release of foreign governmental assets frozen by the U.S. Office of Foreign Assets Control; and represented military contractors in a high-profile, multinational partnership litigation trial.
Roger obtained board certification in International Litigation and Arbitration (Florida Bar, 2019), and served on the inaugural bar committee that wrote the certification exam for aspiring candidates, including as its chairman. He is a past chairman of the International Law Section of the Federal Bar Association and long active in the American Bar Association’s International Law section and several committees. Roger holds an “AV Preeminent” peer review rating in Martindale, the highest rating in the legal profession for professional excellence and ethical standards, has been recognized by Best Lawyers in America (2023 – date), as well as selected to Super Lawyers in Thomson Reuters’ annual survey of the top 5% of lawyers in the New York Metro Area (2022 – date) and Miami (2017 – 2022).
