Although we most frequently represent clients in Chapter 11 proceedings, we also handle matters under Chapters 7, 12, and 13. Our clients include a wide range of secured and unsecured business creditors, such as trade creditors, equipment lessors, real estate lessors, inventory and equipment financiers, banks, and other financial institutions. These creditors rely on KMK’s Business & Financial Services Group to protect their interests—as well as any collateral or leased assets—in the hands of debtors, bankruptcy trustees, or other adverse third parties.
Our attorneys routinely pursue priority and administrative claims, seek relief from the automatic stay, represent clients in Section 363 sales, and address issues related to contract assumption and rejection. We also evaluate reorganization plans and advise companies interested in acquiring assets from bankruptcy estates.
For our secured and unsecured creditor and leasing clients, KMK’s experience in both reorganization and liquidation proceedings allows us to develop tailored strategies, procedures, and alternatives to manage and control credit and loss exposure. At the same time, we help clients maintain business relationships with the debtor—potentially supporting a successful financial reorganization and ongoing business opportunities. If reorganization proves unsuccessful and financial collapse is unavoidable, we work to minimize our clients’ loss exposure.
