April 2019 – After a 9-day trial, Vitacost, an online nutrition company owned by Kroger, was found not responsible for the catastrophic liver damage of Texas man James McCants after taking the company’s green tea extract supplements due to the defense of Primerus law firm Nicklaus & Associates.
McCants received a liver transplant in 2014, after he had been taking Vitacost’s green tea extract supplements and claimed the extract caused the damage leading to the transplant. McCants’s attorney, Clay Miller of Miller Weisbrod, claimed Vitacost had a duty to inform the public about the potential side effects of the green tea extract, including liver failure. Miller explained that these warnings were not listed on the product or on the company’s website.
However, Edward Nicklaus of Nicklaus & Associates had a strong defense that showed the warnings that Vitacost had were satisfactory, the studies surrounding green tea extract did not demonstrate any risks to the liver, and that there was no direct proof that the green tea extract supplements caused the liver failure.
