January 2020, Coral Gables, Florida – Managing Shareholder of Nicklaus & Associates, Edward Nicklaus received CVN Florida’s Defense Attorney of the Year award for 2019. He earned this award for the major products liability case he had won on behalf of Vitacost.com, a Kroger-owned company.
In this case, James McCants claimed he was required to receive a liver transplant after taking Vitacost’s green tea extract.
Nicklaus disputed these claims by explaining that Vitacost’s general warnings were sufficient and studies did not link green tea extract to liver damage. He also noted that McCants was taking additional supplements to the green tea extract, and some of these did have links to liver damage. “Mr. McCants is a self-treater,” Nicklaus said. “What you put in your body, ladies and gentlemen, you ought to get advice for, especially if you’re old enough to know better. That’s just common sense.”
Due to his efforts on this case, Nicklaus was awarded Defense Attorney of the Year for 2019.
