Peter C. Netburn is a shareholder and founding member of Hermes, Netburn, O’Connor & Spearing, P.C.  Peter concentrates his practice on the areas of general, civil and commercial litigation, construction law, surety and fidelity law, insurance coverage and defense, environmental and business law, complex tort, toxic tort and product liability law.  Peter handles matters throughout the New England states and beyond and he regularly litigates cases in state and federal trial and appellate courts.

Peter has extensive experience advising and representing insurers and policyholders in complex, multi-party property damage, bodily injury and environmental insurance coverage disputes.  He regularly prosecutes and defends such cases through both the trial and appellate court phases.  Peter has extensive experience representing manufacturers and distributors of asbestos-containing products in toxic tort cases, and managing such litigation, throughout New England and nationally.

Peter regularly handles construction and surety claims and lawsuits on behalf of contractors and sureties.  He also represents sureties in connection with financial institution fidelity claims around the country.  Peter represents national and multi-national companies with respect to corporate governance and insurance issues.

Peter has been named a Massachusetts and New England SuperLawyer by the publishers of Law & Politics and Boston Magazine in the fields of general litigation and insurance coverage and he has received the highest ranking established by Martindale-Hubbell’s Law Directory.  This rating is only given to lawyers and law firms which are considered to have the Very High to Preeminent legal ability and who are thought to embrace Very High Professional Standards.

Peter was born in London, England, and grew up as an overseas dependent.  He now lives in Sudbury, Massachusetts, with his wife and two children.

OneBeacon Am. Ins. Co. v. Narragansett Elec. Co., et al.

After successful Application for Further Appellate Review to Massachusetts Supreme Judicial Court, Massachusetts Appeals Court reversed Superior Court’s application of Rhode Island law and affirmed the Superior Court’s entry of summary judgment based on pollution exclusion and statute of limitations grounds.

Consolidated Cigar Corp., et al. v. Reilly

U.S. Court of Appeals holding, affirmed by Supreme Court, that Massachusetts Attorney General’s advertising regulations unconstitutionally burdened interstate commerce.

Emhart Indus. Inc. v. Home Ins. Co., et al.

Jury verdict finding no trigger of coverage for contamination at Federal Superfund site. Affirmed by U.S. Court of Appeals.

Guardianship of Enos

Obtained summary judgment, affirmed on appeal, that full faith and credit must be given to Florida adult guardianship order in connection with wrongful removal of elderly woman to Massachusetts.

Holdren et al. v. A.W. Chesterton Co., et al.

Defense verdict for alleged manufacturer of naval equipment in asbestos personal injury action.

Estate of Geraldina M. Medeiros v. A.F. German Co., Inc., et al.

Summary judgment for truck repair shop finding no causation for decedent plaintiff’s asbestos-related disease.

Muliero v. Eastern Refractories Co., Inc., et al.

Obtained summary judgment on behalf of asbestos insulation distributor based upon the Rhode Island statute of repose.

OneBeacon America Ins. Co. v. Haffner’s Service Stations, Inc.

Obtained declaratory judgment of no coverage, affirmed on appeal, that insured’s liability did not arise out of the use of a covered auto.

OneBeacon America Ins. Co. v. Leasing Assoc., Inc.

U.S. Court of Appeals holding that commercial auto policy must be reformed to reflect mutual mistake.

Catastrophic Property Damage Claim

Worked with claimants, experts and insurer to evaluate large product liability crop damage claim and negotiate favorable multi-million dollar pre-suit settlement.

Fidelity Bond Claims

Conduct onsite investigations and analysis of lack of faithful performance and dishonesty claims by financial institutions.

Surety Bond Claims and Litigation

Coordinate completion of construction projects.  Investigate, analyze, litigate and resolve performance and payment bond claims on behalf of surety.  Pursue indemnity recoveries, including multi-million dollar non-dischargeable judgment against personal indemnitor for surety payment and performance bond losses and related expenses.
