Joseph Pope offers our clients extraordinary expertise and experience in the areas of appellate law, bankruptcy and creditors rights, constitutional law, complex commercial and business litigation, intellectual property, products liability, and criminal law.

At the appellate level, Joseph routinely authors briefs and motions in high-stakes litigation involving complex questions of law—including cases before the United States Supreme Court, federal circuit courts, and state appellate courts. He has argued numerous appeals before federal circuit courts and state appellate courts, and has authored a number of amicus briefs filed in federal and state courts across the country.

Clients also rely on Joseph at the trial court level to tackle difficult and complex legal and procedural matters. He has represented clients in shareholder disputes, business tort actions, defamation and First Amendment claims, section 1983 and constitutional tort claims, actions brought under various consumer protection statutes (including the Fair Credit Reporting Act, Fair Debt Collection Practices Act, and Virginia Consumer Protection Act), as well as claims filed under the Virginia Business Conspiracy Act. Joseph has also represented clients in antitrust and unfair competition cases brought under the Sherman Act, the Robinson-Patman Act, and the Virginia Unfair Practices Act. He also has experience handling trademark, trade dress, and copyright matters filed under the Lanham Act.

Joseph also represents clients involved in bankruptcy proceedings. He has experience litigating matters such as fraudulent conveyance and preference claims, trustee surcharge actions, and challenges to Chapter 11 plan confirmations.

With experience handling various criminal matters, including white-collar cases brought in federal court for mail and wire fraud, honest services fraud, and Medicare and Medicaid fraud, Joseph has developed particular expertise in handling sentencing, forfeiture, and restitution issues.

After law school, Joseph clerked for the Honorable Gerald B. Tjoflat of the United States Court of Appeals for the Eleventh Circuit, the Honorable Harvey E. Schlesinger of the United States District Court for the Middle District Florida, and the Honorable Stephen S. Mitchell of the United States Bankruptcy Court for the Eastern District of Virginia.

Joseph is active in several legal and professional organizations, including the Defense Research Institute and its Appellate Advocacy and Class Action Committees. He is also active in the Virginia Bar Association’s Appellate Group, as well as the Virginia Association of Defense Attorneys Appellate Section. Joseph has authored numerous articles that have been published in national and local publications. He is also a regular speaker at federal and state conferences and seminars.
