John Felice is a shareholder of Hermes, Netburn, O’Connor & Spearing, P.C.  He has substantial experience representing insurers, insurance claim administrators, and other stakeholders in connection with complex insurance coverage matters involving toxic tort, asbestos, fidelity, bad faith, products liability, general liability, professional liability, directors and officers liability, sexual abuse and other claims.
 
His wide-ranging experience also includes representing manufacturers and distributors of asbestos-containing products in toxic tort cases pending in multiple jurisdictions.  Mr. Felice has been involved in several jury trials in the Massachusetts asbestos litigation and he recently was part of the trial team which obtained a defense verdict, after a three week jury trial, on behalf of the alleged successor-in-interest to a manufacturer of asbestos-containing products installed aboard U.S. Navy ships.  This was only the third case to be tried to verdict in the Massachusetts asbestos litigation in the past decade.
 
In addition to his insurance and toxic tort practice, Mr. Felice has vast experience defending product liability claims involving motor homes, aircraft, motor vehicle, heavy, industrial and manufacturing equipment, consumer products such as appliances and lawn mowers, and construction and safety equipment, among others.  He also litigates premises liability claims, including negligent security claims.  Finally, Mr. Felice represents owners, general contractors, subcontractors and architects in the defense of construction-related litigation, including personal injury and wrongful death, defective workmanship and breach of contract claims, and he represents sureties in all aspects of bond claims, including negotiation of project completion arrangements, handling of payment bond claims, and pursuit of salvage recoveries.

Holdren v. Viad Corp.

Obtained a defense verdict, after a three week jury trial, on behalf of the alleged successor-in-interest to a manufacturer of asbestos-containing products installed aboard U.S. Navy ships.

Lemos v. Electrolux

Obtained dismissal of lawsuit against lawnmower manufacturer for insufficient service of process and because the Plaintiff’s complaint failed to state a claim upon which relief could be granted.

Ronca v. Barber Associates

Attained favorable settlement for general contractor in case alleging brain injury caused by exposure to toxic chemicals used by a subcontractor retained by the general contractor.

Medeiros v. Ron’s Truck Stop, Inc.

Summary judgment obtained for automotive supplier in case alleging that asbestos-containing friction products were the cause of Plaintiff’s mesothelioma

Donlan v. Turner Construction

Obtained dismissal of lawsuit against general contractor alleging claims that building construction materials were the cause of Plaintiff’s mesothelioma.

Hebert v. Weil-McLain

Attained favorable settlement for boiler manufacturer during trial for claims that asbestos-containing components of heating products were the cause of Plaintiff’s mesothelioma.

Freeman v. Delmont Construction

Attained favorable settlement for water and sewer contractor in case alleging wrongful death caused by toxic exposure to mold that resulted from repeated sewage backups.

Wilmington Builders Supply Company v. DeCourcy

Summary Judgment obtained for homeowner in case in which building material supplier attempted to assert a mechanic’s lien pursuant to Mass. Gen. Laws Ch. 254

Boucher v. Northeastern Log Homes, Inc.

Successfully negotiated dismissal of claim against log home manufacturer alleging improper preservation of logs prior to sale.

Jacobsen v. William A. Berry & Son, Inc.

Attained favorable settlement for general contractor in case alleging personal injuries sustained by subcontractor’s employee as a result of fall from building opening.

OneBeacon America Insurance Company v. Celanese Corporation

Summary judgment obtained for insurer who asserted the right to control the defense of insured where the defense was offered without reservation of rights.
