Countervailing Duties

Governments around the world have an array of policies to support domestic companies and workers.  Certain subsidies, however, can distort global competition by displacing imports from other countries and leading to damaging export surges into other markets.  The countervailing duty law of the United States allows for additional duties to be imposed on imports that benefit from trade-distorting government subsidies and cause harm to a domestic industry.  In addition, the World Trade Organization Agreement on Subsidies and Countervailing Measures permits WTO Members to challenge other Members’ subsidy programs in certain circumstances.

For more than 50 years, Stewart and Stewart has been helping industries and their workers respond to harm caused by foreign subsidies. Our team has in-depth knowledge of WTO subsidy rules and the U.S. trade laws, and we understand the factual and legal elements that impact the outcome of subsidy challenges and countervailing duty cases.  Our team can assist clients in any aspect of these proceedings, as well as litigation in U.S. courts and disputes at the WTO.  Stewart and Stewart has also been active in helping to shape new legislation and regulations that both benefit our clients and lead to good public policies.  With local counsel, we can also help clients pursuing countervailing duty cases abroad for their foreign operations or to defend where their exports are caught up in foreign investigations.
