Daniel B. Fitzgerald Honored for Making a Difference in 2011

The law firm of Brody Wilkinson PC is pleased to announce that Daniel B. Collins & Lacy, P.C. Founding Partners Selected for Leadership in the Law Awards

Collins & Lacy, P.C. is pleased to announce that founding partners, Joel Collins and Stan Lacy have been selected as recipients of the South Carolina Lawyers Weekly 2012 Leadership in the Law Awards. They will be recognized at the Leadership in the Law awards dinner on Thursday, March 15th at the Francis Marion Hotel in downtown Charleston.

The awards were designed to spotlight those members of the legal community whose leadership, both in the legal profession and in the community, has made a positive impact on our state. The recipients were selected by a panel of judges based on their outstanding achievement in the following key areas: dedication to the legal profession, achievement in their legal career, along with mentoring and community involvement.

Joel Collins, together with Stan Lacy, co-founded Collins & Lacy in 1984 as a firm that would concentrate primarily on business defense litigation. Mr. Collins received his Juris Doctor from the University of South Carolina School of Law and currently chairs the firm’s Professional Liability practice group. He was the recipient of the 2002 Jeter E. Rhodes, Jr., Trial Lawyer of the Year Award, presented by the South Carolina Chapter of ABOTA. In 2009, Mr. Collins founded, through the South Carolina Chapter of ABOTA, the Constitution Day James Otis Scholar Lecture program, which recognizes students who excel in the study of History. He is a member of the International Society of Barristers, Litigation Counsel of America, and serves as a board member of the South Carolina Chapter of the National Safety Council. In 2005, he received the James Petigru Compleat Lawyer Award from the University of South Carolina School of Law. Mr. Collins is listed as one of South Carolina’s preeminent attorneys according to Martindale-Hubbell. Joel’s reputation in the courtroom and professional standing has led his peers to consider him one of South Carolina’s preeminent attorneys, according to Martindale-Hubbell.

Stan Lacy graduated from the University of Virginia in 1967 and earned his law degree from the University of South Carolina School of Law in 1974. South Carolina Governor Carroll Campbell appointed him to the Advisory Committee for the Improvement of Workers’ Compensation Laws in South Carolina, where he worked with the legislature to review and revise legislation affecting the state’s workers’ compensation system. Mr. Lacy began teaching workers’ compensation as an adjunct instructor at the USC School of Law in 1981 and has continued to teach ever since. He was the recipient of the South Carolina Workers’ Compensation Educational Association (SCWCEA) 2011 Lifetime Service Award. Mr. Lacy is AV-rated by Martindale-Hubbell, has been selected by his peers for seven consecutive years to be included in The Best Lawyers in America, and was most recently honored by Best Lawyers as the 2012 Columbia, S.C. Lawyer of the Year for Workers’ Compensation Law.

Russell Advocaten Holds Traditional New Year’s Reception for the 29th Straight Year

On Monday, 16 January 2012, Russell Advocaten held their traditional New Year’s reception for the 29th year in succession. Some 600 guests attended the reception at the famous Amstelveen Cobra museum.

On Wednesday, 18 January the event was featured in a large article along with several photos in the national newspaper “De Telegraaf” and dubbed “the reception of receptions.” With 800,000 subscribers and over 2 million readers “De Telegraaf” is the largest daily newspaper of the Netherlands. Enclosed is a copy of the article for an impression of the event.

Peter Bennett, Chair of the ABA Standing Committee on Judicial Independence to sit on the ABA hearing Committee February 3, 2012

On Friday, February 3, 2012, the ABA Standing Committee on Ethics and Professional Responsibility (“Ethics Committee”) and the ABA Standing Committee on Professional Discipline (“Discipline Committee”) will hold a public hearing from 9:30 a.m. to 11:30 a.m. at the Sheraton New Orleans Hotel, 500 Canal Street, Napoleon Ballroom C3, 3rd Floor, New Orleans, LA. The topic of the hearing will be “Proposed Amendments to the Model Code of Judicial Conduct and the Model Rules of Professional Conduct Regarding Judicial Disqualifications and Judicial Campaign support disclosure”.

In recent years, judicial disqualification has emerged as an important policy issue in numerous states, the United States Supreme Court, and is even an important focus of discussion and debate on ways to improve both the reality and the public perception of the fairness and impartiality of our court system. That focus has been sharpened because of intense public scrutiny and criticism in several highly publicized cases of refusals by judges to recuse themselves in circumstances where the judge’s impartiality might reasonably be questioned.

Resolution 107, which was approved by the House of Delegates at 2011 Annual Meeting, stated that “the Standing Committee on Ethics and Professional Responsibility and the Standing Committee on Professional Discipline should proceed on an expedited basis to consider what amendments, if any, should be made to the ABA Model Code of Judicial Conduct or to the ABA Model Rules of Professional Conduct to provide necessary additional guidance to the states on disclosure requirements and standards for judicial disqualification.”

In light of these developments and to fulfill the House of Delegates’ directive, the Ethics and Discipline Committees are circulating for comment proposed amendments to Model Code of Judicial Conduct Rules 2.11, 4.4, the Terminology section, alternative proposals for amendments to the Model Rules of Professional Conduct, new Rule 5.1 A, and a new Model Supreme Court to provide necessary additional guidance to the states on disclosure requirements and standards for judicial disqualification.

The February 3, 2012 public hearing will serve as an open session to discuss these proposals. The Committees welcome testimony from the profession and the public. Appearances are limited to five minute presentations followed by a five minute question and answer period. The Committees will work to accommodate all appearance requests.

Collins & Lacy, P.C. Gains Statewide Leadership Presence in Legal Associations

Collins & Lacy, P.C. has gained a vast leadership presence in legal associations across the state. The business defense firm is pleased to announce six paralegals are serving in leadership roles within their respective professional associations for 2012.

In the Upstate, Barbara Spearman has been officially sworn in as the 2012 President of the South Carolina Upstate Paralegal Association (SCUPA). Spearman, of Collins & Lacy’s Greenville office, has been a member of SCUPA for the past 20 years. She has previously held the offices of Treasurer, Secretary and Seminar Committee Chairperson. Barbara was a recipient of the Paralegal of the Year Award in 1995 and 2007. Also from the Greenville office, Collins & Lacy’s Daysha Bonner is the new Co-Chair of SCUPA’s 2012 Pro Bono Committee. The committee focuses on giving back to the community through projects, donations and services.

In the Midlands, Collins & Lacy has four paralegals honored with leadership roles within the Palmetto Paralegal Association (PPA). The PPA was established in 1988 to promote professional development through continuing legal education and to enhance the recognition of the paralegal profession within the legal community.

During a ceremony Wednesday, Justice Costa M. Pleicones inducted the 2012 Board. It included Collins & Lacy’s Vickie Baker as First Vice President and Education Chairman, Cyndi Miller as Chair of the Ways & Means Committee, Kelli Spinks as Chair of the Employment Information Committee, and Roshel Tuska as Secretary.
