As most of you are aware, the Department of Labor had promulgated regulations that would have dramatically increased the number of employees eligible to be paid overtime. Those regulations were scheduled to be implemented on December 1, 2016. A Texas Federal Court has now enjoined the implementation and enforcement of those regulations. You may find the Court's opinion here.

While the future of this regulation remains unclear, as of now the old regulations will remain in effect. There is the potential that the Department of Labor may appeal this decision to the Court of Appeals for the Fifth Circuit or the United States Supreme Court. Another variable is the change in administrations. Assuming that the injunction remains in effect through January, the new administration can decide to abandon the proposed regulations or to seek their implementation.
