Michael Batson is a shareholder at Hermes, Netburn, O’Connor & Spearing, P.C. Michael concentrates his practice in the areas of general, civil and commercial litigation, construction law, insurance coverage and defense, environmental law, complex tort and product liability law. Michael has more than a decade of experience representing insurers and policy holders, individuals and corporations in complex litigation matters.

Michael represents clients in connection with claims for coverage on general liability, property, professional liability, directors and officers liability, umbrella and excess policies, and fidelity and surety bonds. Michael regularly represents owners, general contractors and subcontractors in construction-related litigation, including breach of contract claims and claims involving defective workmanship, personal injury and wrongful death. In addition to his insurance and construction practice, Michael represents clients in defense of class actions. Michael’s broad background also includes handling matters involving defamation claims, non-construction-related breach of contract claims, stockholder disputes, fraud claims, bad faith claims, building leaks and violations of the Telephone Consumer Protection Act.

Michael frequently handles matters in Massachusetts’ state and federal trial and appellate courts, including the Massachusetts Business Litigation Session. He is admitted to practice in Massachusetts and handles cases throughout the Northeast.

Attained denial of class certification in action brought against insurer pursuant to M.G.L. c. 93A regarding the handling of total loss automobile claims.  Attained dismissal of named plaintiff’s direct claim following 4-day trial.

Mueller Co. n/k/a/ Mueller Co. Ltd., et al. v. Commercial Union Insurance Company n/k/a OneBeacon America Insurance Company, et al.

Attained favorable resolution of matter on behalf of insurer client, including favorable summary judgment ruling regarding number of occurrences under Illinois law.

Attained favorable class action settlement for insurance company regarding claims brought on behalf of class for alleged failure to pay post-award interest on arbitration awards

OneBeacon America Ins. Co. v. Haffner’s Service Stations

Summary judgment obtained and affirmed by Massachusetts Appeals Court for insurer on grounds that automobile insurance policy did not cover oil discharge resulting from negligent repair services.

OneBeacon America Ins. Co. v. Travelers Indem. Co. of Ill

Secured First Circuit decision reversing the District Court and ordering that summary judgment be entered in favor of OneBeacon providing for reformation of an insurance policy.

Walpole Country Club, Inc. v. Sansone Brothers, Inc., et al.

Attained favorable settlement for sand and gravel business for claims relating to the alleged release of sediment and hazardous materials.
