John D. Barry has been a civil litigator for nearly 40 years, defending clients in cases involving torts, contracts, products liability, insurance and casualty. He serves in an Of Counsel role in Spicer Rudstrom’s Chattanooga office.

John has represented numerous nationally known insurance carriers, including the State Farm Companies, the Hartford Companies and their insureds in matters involving fire and arson issues, bad faith claims, construction disputes, commercial and residential premises liability, commercial and private owner automobile liability, uninsured motorist actions, and watercraft accidents in state and federal courts. He has also been involved in multidistrict litigation involving class action matters where pharmaceutical liability was alleged. He has been active in appellate litigation, having represented clients as lead counsel in numerous reported appeals before the Appellate and Supreme Courts of Tennessee and Georgia, as well as the United States Courts of Appeal for the Sixth and Eleventh Circuits.

The Macon, Ga. native attended law school at Mercer University. Following graduation, he attended The Judge Advocate Generals (JAG) School at the University of Virginia. He was commissioned as captain of the U.S. Army Reserve and assigned to the 24th infantry division in Fort Stewart, Ga., where he served as the legal assistance officer and defense counsel for service members involved in trials. John was then assigned as chief prosecutor and officer in charge of the JAG Corps branch office at Hunter Army Airfield. In 1978, he was awarded the Army Commendation Medal for meritorious service and excellence in the administration of justice. He currently holds rank of lieutenant colonel, retired.

John pursued law as a career in fear of not knowing his rights and the rights of those confronted by the legal system. His professional passion is to protect the legal interests of his clients both properly and effectively. John joined what was the then-named firm of Milligan, Hooper and Harris as an associate in 1978 and was named partner in 1983. He left as the principal of Milligan-Barry to join Spicer Rudstrom.

He is a member of the Chattanooga Bar Association Fee Dispute Resolution Committee and the Chattanooga Military Lawyers Association. He is a former member of the District 3 Investigating Committee of the Tennessee Board of Law Examiners. John has been a frequent lecturer and speaker for organizations like the Federation of Defense and Corporate Counsel, National Business Institute and the Tennessee Court Reporters Association. He also served as an adjunct professor of law at Embry-Riddle University.

John and his wife, Emmie-Keith, raised their family in Signal Mountain, Tenn., where John has resided for nearly 40 years. They have two adult sons. He is an avid sportsman, spending time outside the office bass and crappie fishing and hunting dove, pheasant, quail and duck. It was his time as a taxi driver while in college that gave John the opportunity to experience a variety of human behaviors and is what he credits for his calm, empathetic demeanor in human relations.
