Why You Should Attend

David Ball and Gary Johnson will lead an intimate program on "Overcoming the Tribal Divide". Over the course of three days, they will teach advocacy methods - many new, some refined from before - that in addition to their power with juries, serve the additional purpose of helping unite divided juries. Divided juries more and more are a serious problem due to the nation's overtly nasty political divisions, so jurors on opposite sides of the political divide are less likely to agree with each other about anything else. Especially not verdicts. And still, the tribal divide is not just limited to political affiliation. The group will explore other divisions keeping juries from seeing eye to eye. Within this framework, the program will include:

In addition to the 10+ hours of classroom time, David and Gary will conduct one-on-one sessions with all attendees. The time can be spent discussing a problematic case or working on a specific trial skill - whatever direction attendees choose. Case/Issue summaries will be submitted in advance for David and Gary's review so as to maximize the one on one time onsite during the Conference.

Of course, when the substantive programming ends, there is plenty to explore and experience in the beautiful Dominican Republic. Whether you take advantage of the all-inclusive package and relax by the pool, prefer a more active afternoon on the beach, play a round of golf, or want to explore one of the local Dominican attractions - we have built in time for you to do so! Spouses/Guests are encouraged to attend and there is more for them this year than ever before. As is customary, reservations have been made at a different property restaurant each evening for the group to come back together for dinner, drinks and company.

Speakers

David Ball, a co-founder of Reptilian Advocacy, is a litigation strategist with North Carolina's Malekpour & Ball Consulting (JuryWatch, Inc.). He is the nation's most influential jury consultant, communications expert, and advocacy teacher. His training is in science, engineering, small-group communications, and theater, and he is a 30-year veteran of the professional theater.

Dr. Ball and his partner, lawyer/consultant Artemis Malekpour, consult on civil and criminal cases of every size across the country, and are routinely credited with turning the most difficult cases into high-verdict victories. They are the nation's only trial consultants qualified to safely and comprehensively guide attorneys with Reptilian methods and strategy.

Dr. Ball is also a pioneer in adapting film and theater methods into trial techniques. His theater/film students have won Oscars, Obies, Tonies, and Emmies; his scripts have been done at professional theaters off-Broadway and throughout North America and overseas; his major theater credits include the Guthrie Theater and Carnegie-Mellon University's renowned theater conservatory. His best-selling film and theater training book, Backwards and Forwards, has been the field's standard every year since 1984, and perennially occupies a top spot on Amazon. And for nearly three decades, the three editions of his best-selling crossover text, Theater Tips and Strategies for Jury Trials, have set the standard for the use of film and theater techniques in litigation.

Dr. Ball has taught law students at North Carolina, Wake Forest, Pittsburgh, Minnesota, Roger Williams, Loyola, and Campbell schools of law, and at Duke University as Senior Lecturer in Law. He's an award-winning teacher for the North Carolina Advocates for Justice and the American Association for Justice's National College of Advocacy. He has long been the nation's most in-demand Continuing Legal Education speaker.

Dr. Ball is also the author of the two best-selling trial strategy books ever written: David Ball on Damages and -- with Don Keenan -- Reptile: The 2009 Manual of the Plaintiff's Revolution. His latest book is David Ball on Criminal Defense.

 

Gary C. Johnson has been representing Plaintiffs in personal injury cases for over 40 years. He is the founder of Gary C. Johnson, P.S.C. which currently has 13 attorneys in four offices located in Pikeville, Lexington, Louisville and Hazard, Kentucky.

He has received several multi-million dollar jury verdicts and settlements over his long and distinguished career. He has the largest personal injury jury verdict of any lawyer in the state of Kentucky. He has tried cases in Kentucky, Georgia and West Virginia. He has also handled cases in several other states.

Gary C. Johnson continues to devote the majority of his time to the day-to-day practice of law. His firm's practice consists entirely of Plaintiff personal injury cases in the fields of vehicular negligence, products liability, and medical malpractice. In the last few years, however, Gary has diverted some of his time to the education of other trial lawyers. He has presented seminars for the Kentucky Bar Association, Kentucky Justice Association and the American Association of Justice on trial strategy and how to maximize damages in your case.

Over a period of four years Gary was involved in national research of juror attitudes. Gary C. Johnson, David Ball, Don Keenan, and Jim Fitzgerald set out to determine if there was a way to counter the insurance companies' propaganda which had literally poisoned modern jurors against injured victims. After four years of focus groups across the country the group concluded that there was an answer. A decision was made to share the research with other plaintiff lawyers and this led to the publication of the book, "Reptile - The 2009 Manual of the Plaintiff's Revolution". David Ball and Don Keenan, two members of the research group are the authors of this book. This research "wrote the book" for the modern approach to jury persuasion.

Gary C. Johnson has over the years helped new lawyers on an individual basis represent injured people. He is pleased that many of his proven methods have been published. He is sharing with the Plaintiff's Bar the secrets of his success as a preeminent trial lawyer. Gary recently authored a chapter on Judo Law in "Reptile in the Mist" by David Ball and Don Keenan.
